The Department for Education is reviewing its policy on approval of pass-through arrangements in the LGPS.
In our recent ebriefing and webinar, we highlighted the need for academies to obtain consent from the Education Skills and Funding Agency (EFSA) where they are putting in place pass-through arrangements with contractors around the costs of being an employer in the LGPS.
The current position is that where staff have never been employed by the academy, consent to a pass-through will not be given. However, we understand that EFSA is currently looking at whether to change its policy on this, so that a pass-through will not automatically be rejected for this category of staff.
Unfortunately, the wheels are not going to turn quickly on this and it’s likely to be later in the year before we hear whether there will indeed be a change of policy.
